• Commissions will start at 10% of each order, after any discounts, unless otherwise agreed upon between you and PiecesofThere directly.
• Your commission will increase to 12% after the first 150 orders made on PiecesofThere through your referral link and 15% after the first 250 orders, per year.
• Merchant shall make available to Affiliate certain images (logo or product image), description of company and products for sale, and url link to Merchant website.
• Affiliate shall display these Promotional Materials on Affiliate’s website and/or enewsletter as agreed upon.
• Affiliate will not display direct competitors (packages of local products) of Merchant on the Affiliate’s website at the same time that the Merchant’s Promotional Materials are displayed.
• Affiliate may only use the Promotional Materials for the purpose of promoting Merchant’s website (and the products and services available thereon), and for linking to Merchant’s website.
• Affiliate will not alter, add to, subtract from, or otherwise modify the Promotional Materials as they are prepared by Merchant. If Affiliate wishes to alter or otherwise modify the Promotional Materials, Affiliate must obtain prior written consent from Merchant for such alteration of modification.
• The Promotional Materials will be used to link only to Merchant’s website, to the specific page and address as specified by Merchant.
o In exchange for Affiliate’s display of the Promotional Materials, and for Affiliate’s compliance with and performance of the terms and conditions of this Agreement, Merchant shall pay to Affiliate a commission (the “Commission”) in the percentage that was decided of product sold to a user that accesses Merchant’s website through a link on Affiliate’s website.
o Merchant shall keep accurate and up-to-date records of the data used to determine the total amount of Commissions owed to Affiliate. Merchant will use a 3rd party affiliate tracking software to track conversions by Affiliate and commissions owed to Affiliate.
• Affiliate shall be given reasonable access to the 3rd party reporting software to view conversion and commission analytics.
• Merchant shall pay all Commissions accrued and payable to Affiliate on a monthly payment schedule. Payments will be paid by Merchant to Affiliate within 7 days of the first day of each month (the “Commission Payment Date”). Merchant will pay Affiliate by check at the end of each month. Payments will include all Commissions owed to Affiliate for conversions acquired over the past month.
• In the event that this contract is breached or the relationship ends by either the Affiliate or Merchant via written consent, Affiliate has 24 hours to remove Merchant’s materials from their website. After 24 hours, the Merchant is not obligated to pay such Commissions to Affiliate.
• Affiliate will not make any claim to ownership of the Promotional Materials, or of the copyright, trademark, or other intellectual property therein.
• Affiliate will not engage in the distribution of any unsolicited bulk emails (spam) in any way mentioning or referencing Merchant or Merchant’s website.
